On behalf of the Indiana Department of Transportation (INDOT), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process for new rules not later than 60 days after the effective date of the statutes that authorize the rule, unless a notice is filed with the publisher that includes the reasons why rulemaking began more than 60 days after the effective date.

To comply with IC 4-22-2-19(b) and IC 4-22-2-19(c), INDOT is asking for an extension on the worksite safety automated enforcement pilot program. The statutory authority for rulemaking that allows INDOT to promulgate these rules is IC 8-23-32-21.

INDOT was unable to begin the rulemaking process within 60 days of the authorizing statute's effective date with regard to the worksite safety automated enforcement pilot program and needed time to conduct research and solicit industry input.
