EXECUTIVE ORDER: 23-08

FOR: POSTPONING THE EXPIRATION OF CERTAIN ADMINISTRATIVE RULES

TO ALL WHOM THESE PRESENTS MAY COME, GREETINGS:

WHEREAS, IC 4-22-2.6 provides that an administrative rule expires January 1 of the fifth year after the year in which the rule takes effect, unless the rule expires or is repealed on an earlier date, or except as otherwise specified in IC 4-22-2.6-1 or -10;

WHEREAS, IC 4-22-2.6-1(b)(1) provides that if the latest version of a rule became effective in calendar year 2017, then the rule expires not later than January 1, 2024;

WHEREAS, IC 4-22-2.6-10 provides that if a rule is not readopted and the governor finds that the failure to readopt the rule causes an emergency to exist, the governor may, by executive order before the rule's expiration date, postpone the expiration date of the rule until a date that is not later than one (1) year after the date specified in IC 4-22-2.6-1;

WHEREAS, the Board of Animal Health (BOAH) submitted a request to the Governor for an extension of one (1) year for the following rules, as designated by the citation to the Indiana Administrative Code, which were last readopted in 2017, have not been readopted since, and will expire January 1, 2024 without further action:

WHEREAS, failure to readopt the rules cited above would cause an emergency to exist, such that it is necessary and appropriate to postpone their expiration date;

NOW, THEREFORE, I, Eric J. Holcomb, by virtue of the authority vested in me as Governor of the State of Indiana, do hereby order that the expiration date of rules 345 IAC 6-2-2, 6-2-3, 6-2-4, 6-2-5, & 6-2-6, shall be postponed for one (1) year until January 1, 2025.
