Under IC 4-22-2-37.1, the Governor gives the Indiana Department of Transportation approval to publish a Provisional Rule concerning the insurance, administration, fee structure, and enforcement of overweight divisible load permits, and to clarify when the department has the authority to temporarily raise the maximum allowable number of single trip permits.

Dear Commissioner Smith:

Pursuant to the provisions of Indiana Code § 4-22-2-37.1, the Governor has reviewed the proposed provisional rule that temporarily adds a rule, which you submitted on September 29, 2023. And it is noted that the General Assembly, pursuant to Indiana Code § 9-20-6-2.2, provided authority for your agency to promulgate regulations in order to ensure that carriers would be able to respond to emergencies or changes in market conditions.

The Governor hereby finds, pursuant to Indiana Code § 4-22-2-37.1(b)(1), that the proposed provision rule is necessary to avoid an imminent and substantial peril to public health, safety, or welfare before a final rule can take effect. A regular rule is not expected to be completed until 2024.

The Indiana Department of Transportation may proceed with the provisional rule proposed in its submission.
