IC 4-22-2-37.1, the Governor gives the Department of Insurance approval to publish a Provisional Rule concerning the Indiana all payer claims database.

Pursuant to the provisions of Indiana Code § 4-22-2-37.1, the Governor has reviewed the proposed provisional rule that temporarily adds a rule, which you submitted on September 13, 2023.
The Governor hereby finds, pursuant to Indiana Code § 4-22-2-37.1(b)(4), that the proposed provisional rule is necessary to avoid an imminent and substantial violation of
IC 27-1-44.5 as the current emergency rule adopted in June 2023 to implement
IC 27-1-44.5 will expire September 23, 2023, before a final rule can take effect. As noted, the new regulations went into effect on June 25, 2023, and a regular rule is not expected to be completed until March 21, 2024.
The Indiana Department of Insurance may proceed with the provisional rule proposed in its submission.
