Notice of Public Comment Period for Rule Readoption

Readopts rules in anticipation of
IC 4-22-2.6, providing that an administrative rule adopted under
IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the publisher.
OVERVIEW
Rules to be readopted without changes are as follows:

Based on the regulatory analysis performed by the Indiana Pesticide Review Board:
(1) There is a continued need for this rule.
(2) Civil penalties for failure to comply are reasonable and justified.
(3) Complaints and comments encountered by OISC or the regulated communities have been relatively nonexistent since the first couple of years of implementation.
(4) Difficulties encountered by OISC or the regulated communities have been relatively nonexistent since the first couple of years of implementation.
(5) Economic conditions have not changed appreciably since original implementation.
(6) Technology advancements (all e-communications) since original implementation have made compliance easier.
REQUEST FOR PUBLIC COMMENTS
At this time, the Indiana Pesticide Review Board solicits the following:
(1) The submission of alternative ways to achieve the purpose of the rule.
(2) The submission of suggestions for the development of draft rule language.
