Notice of Public Comment Period for Rule Readoption

Readopts rules in anticipation of
IC 4-22-2.6, providing that an administrative rule adopted under
IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the Publisher.
OVERVIEW
Rules to be readopted without changes are as follows:
410 IAC 1-6 Offering of Human Immunodeficiency Virus Information and Counseling and
Human Immunodeficiency Virus Testing
Rules to be repealed without changes are as follows:
None
This rule sets standards for providing human immunodeficiency virus information to pregnant women, as well as testing for pregnant women and newborns. A pregnant woman has the option of refusing the test after receiving the information. There is a continued need for this rule. Testing the mother allows for prompt treatment with antiretroviral drugs to prevent transmission to the fetus. There are no alternative ways to prevent transmission to fetuses. The problem this rule was intended to address still exists, and the benefits of the rule are still being provided. This rule does not include any fines or penalties. The rules do the aforementioned in the least restrictive manner possible. There have been no complaints or comments received from the public regarding these rules. The rules are written for ease of comprehension and have practicable enforcement.

At this time, the Indiana Department of Health solicits the following:
(1) The submission of alternative ways to achieve the purpose of the rule.
(2) The submission of suggestions for the development of draft rule language.
