Notice of Public Comment Period for Rule Readoption

Readopts rules in anticipation of IC 4-22-2.6, providing that an administrative rule adopted under IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the Publisher.

SUMMARY OF FINDINGS UNDER IC 4-22-2.6-4
IC 16-41-37.5 requires the Indiana Department of Health (IDOH) to adopt rules under IC 4-22-2 to establish an indoor air quality inspection, evaluation, and employee notification program to assist state agencies in improving indoor air quality. The rules ensure that indoor air quality in schools is safe for students and staff in the least restrictive manner possible. The rules do not include any fees, fines, or penalties. IDOH has received limited complaints or comments about schools not having adequate space above drop ceilings to have the required ducted returns. IDOH has prepared an interpretation to the rules that has helped schools achieve the best air quality under the circumstances.

REQUEST FOR PUBLIC COMMENTS
At this time, the Indiana Department of Health solicits the following:
(1) The submission of alternative ways to achieve the purpose of the rule.
(2) The submission of suggestions for the development of draft rule language.
