TITLE 312 NATURAL RESOURCES COMMISSION

60 Day Requirement (IC 4-22-2-19)

On behalf of the Department of Natural Resources (DNR), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process for new rules not later than 60 days after the effective date of the statutes that authorize the rule, unless a notice is filed with the publisher that includes the reasons why rulemaking began more than 60 days after the effective date.

To comply with IC 4-22-2-19(b) and IC 4-22-2-19(c), DNR is asking for an extension on the following:
1. General license for streambank protection.
2. General license for removal of a tree.
3. General license for creek rock removal.

DNR was unable to begin the rulemaking process within 60 days of the authorizing statute's effective date at this time with regard to the general licenses as they are conducting research as well as working with stakeholders and landowners regarding the licenses.
