Notice of Public Comment Period for Rule Readoption

Readopts rules in anticipation of IC 4-22-2.6, providing that an administrative rule adopted under IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the Publisher.

SUMMARY OF FINDINGS UNDER IC 4-22-2.6-4
The Indiana State Board of Animal Health (BOAH) has general supervision over the prevention, detection, control, and eradication of diseases affecting the health of animals within and in transit through Indiana, and also has the duty to oversee the processing and distribution of products derived from animals to control health hazards that may threaten the public health and welfare of the citizens of Indiana. IC 15-17-3-11. The BOAH is authorized to adopt rules under IC 4-22 that are reasonable and necessary to discharge these duties. The rules to be readopted implement both IC 15-17 and IC 15-18.

A full review was conducted for each rule to be readopted to consider the continued need for the rule. This review resulted in a finding that each rule to be adopted met the standards in IC 4-22-2-19.5 and (if applicable) the requirements for fees, fines, and civil penalties in IC 4-22-2-19.6. The agency reexamined previous cost benefit, economic impact, and fiscal impact statements prepared by the agency for the rule under IC 4-22-2-28 and IC 4-22-2.1-5. This review resulted in a finding that there has not been any change in circumstances that affect the analysis. The BOAH evaluated alternative methods of achieving the purpose of each rule to be readopted and the additional factors that are required to be considered in the review pursuant to IC 4-22-2.6-4(b).

REQUEST FOR PUBLIC COMMENTS
At this time, the Indiana State Board of Animal Health solicits the following:
(1) The submission of alternative ways to achieve the purpose of the rule.
(2) The submission of suggestions for the development of draft rule language.
