Notice of Public Comment Period for Rule Readoption

Readopts rules in anticipation of
IC 4-22-2.6, providing that an administrative rule adopted under
IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the Publisher.
OVERVIEW
Rules to be readopted without changes are as follows:
905 IAC 1-42 Nonprobationary Enforcement Officer; Discharge, Demotion, or Suspension
Rules to be repealed without changes are as follows:
None
The Indiana Alcohol and Tobacco Commission (commission) hereby finds that this rule readoption:
(1) does not impose any expenses on regulated entities, persons who pay taxes or pay fees for government services, or consumers of products and services of regulated entities;
(2) achieves its regulatory goal in the least restrictive manner;
(3) avoids duplicating standards found in state or federal laws;
(4) is written for ease of comprehension; and
(5) has practicable enforcement.
The commission also hereby finds that there are no alternative methods of achieving the purpose of the rule that are less costly or less intrusive. Since its last readoption, the agency has not received any complaints or comments from the public concerning the rule or its implementation, has not encountered any difficulties in administering the rule, and there are no technological or economic conditions that have changed in the area affected by the rule since the last time the rule was reviewed and readopted.
REQUEST FOR PUBLIC COMMENTS
At this time, the Alcohol and Tobacco Commission solicits the following:
(1) The submission of alternative ways to achieve the purpose of the rule.
(2) The submission of suggestions for the development of draft rule language.
