Dear Chair Allen:

Pursuant to the provisions of Indiana Code § 4-22-2-37.2, the Governor has reviewed the proposed interim rule that temporarily supplants 905 IAC 1-11.1-2, 905 IAC 1-41-4, and 905 IAC 1-53-5 and temporarily adds a rule pertaining to designated outdoor refreshment areas, which you submitted on June 19, 2023.

The Governor hereby finds, pursuant to Indiana Code§ 4-22-2-37.2(b)(l) and (2), that the proposed interim rule is necessary to implement a new state law, specifically Indiana Code Chapter 7.1-3-31, which went into effect July 1, 2023, pursuant to SEA 20, and to implement a change in state law, specifically Indiana Code§ 4-23.5-5-16, which went into effect July 1, 2023, pursuant to SEA 172, before a final rule can take effect. The new laws were effective July 1, 2023, and a regular rule is not expected to be completed until in or about March 2024.

The Indiana Alcohol & Tobacco Commission may proceed with the interim rule proposed in its submission.
