TITLE 305 INDIANA BOARD OF LICENSURE FOR PROFESSIONAL GEOLOGISTS

Notice of Public Comment Period for Rule Readoption

Readopts rules in anticipation of IC 4-22-2.6, providing that an administrative rule adopted under IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the Publisher.

305 IAC 1-2 Definitions
305 IAC 1-3 Issuance, Renewal, and Denial of Geologist Licensures
305 IAC 1-4 Special Provisions
305 IAC 1-5 Code of Ethics

Rules to be repealed without changes are as follows:
None

SUMMARY OF FINDINGS UNDER IC 4-22-2.6-4
The board is required as per IC 25-17.6-3-12 to create rules for the licensing of professional geologists. The last cost benefit, economic impact, and fiscal impact were conducted in 2019 that resulted in an increase in application and renewal fees so that the board would remain solvent. No changes have taken place since then. The licensing board has received no complaints in the last 10 years. The licensing of professional geologists is managed by the Indiana Geological and Water Survey. The survey has successfully and efficiently administered this program since required by statute in June 1980. Licensed professional geologists are independently licensed and therefore have no impact on state agencies and businesses.

REQUEST FOR PUBLIC COMMENTS
At this time, the Indiana Board of Licensure for Professional Geologists solicits the following:
(1) The submission of alternative ways to achieve the purpose of the rule.
(2) The submission of suggestions for the development of draft rule language.
