EXECUTIVE ORDER: 23-04

FOR: RESCISSION OF EXECUTIVE ORDERS 2-89 & 13-03


TO ALL WHOM THESE PRESENTS MAY COME, GREETINGS:

WHEREAS, on January 17, 1989, Governor Evan Bayh signed Executive Order 2-89, entitled:

"REQUIRING THAT STATE AGENCIES CALCULATE THE FISCAL IMPACT OF PROPOSED RULES AND SUBMIT SUCH RULES TO THE STATE BUDGET AGENCY FOR APPROVAL";

WHEREAS, on January 14, 2013, Governor Michael Pence signed Executive Order 13-03, entitled:

"PROMOTING JOB CREATION, ECONOMIC DEVELOPMENT, AND FREEDOM BY ORDERING A MORATORIUM ON REGULATIONS";

WHEREAS, on May 4, 2023, I signed House Enrolled Act 1623 into law, which makes significant changes to the administrative rulemaking process (HEA 1623);

WHEREAS, HEA 1623 has codified much of Executive Order 2-89 and Executive Order 13-03, thereby rendering their continuation unnecessary; and

WHEREAS, in light of the above, it is appropriate to rescind both Executive Orders 2-89 and 13-03.

NOW, THEREFORE, I, Eric J. Holcomb, by virtue of the authority vested in me as Governor of the State of Indiana, do hereby order that Executive Orders 2-89 and 13-03 are hereby rescinded in their entirety, effective immediately.
  IN TESTIMONY WHEREOF, I, Eric J. Holcomb, have hereunto set my hand and caused to be affixed the Great Seal of the State of Indiana, on this 6th day of July, 2023.
