TITLE 312 NATURAL RESOURCES COMMISSION

Emergency Rule

DIGEST

Temporarily amends 312 IAC 9-3-4 regarding: (1) statewide quotas for hunting deer by county; and (2) designated properties managed by the department of natural resources where antlerless deer may not be taken by the holder of an extra deer license. Effective June 30, 2023.


SECTION 1. (a) This SECTION supplements 312 IAC 9-3-4(g) and governs hunting antlerless deer by the holder of an extra deer license.

(b) Except as provided in subsection (c) and SECTION 2 of this document, an individual may not take an antlerless deer on a property designated by the department from September 23, 2023, through January 1, 2024.

(c) An individual may take an antlerless deer under this SECTION if either of the following conditions are met:
(1) The individual is issued a license to hunt deer with:
(A) a resident extra deer bonus antlerless license under IC 14-22-12-1(a)(18);
(B) a nonresident extra deer bonus antlerless license under IC 14-22-12-1(a)(19);
(C) a resident youth consolidated hunting, fishing, and trapping license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
(D) a nonresident youth extra deer bonus antlerless license under IC 14-22-12-1(a)(32);
(E) a resident extra deer license bundle under IC 14-22-11-10(a) or IC 14-22-12-1(a)(18);
(F) a nonresident extra deer license bundle under IC 14-22-12-1(a)(19);
(G) a nonresident youth extra deer license bundle under IC 14-22-12-1(a)(32);
(H) an apprentice license under IC 14-22-12-1.7(a) through IC 14-22-12-1.7(g);
(I) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4) before its repeal; or
(J) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5) before its repeal.
(2) The individual is hunting antlerless deer without a license under IC 14-22-11-1 or 312 IAC 9-2-14.

(d) An individual may hunt antlerless deer under this SECTION as follows:
(1) Beginning September 23, 2023, through September 24, 2023, an individual may hunt with a bow and arrow, crossbow, firearm, air gun, or muzzleloading gun.
(2) Beginning October 1, 2023, through January 7, 2024, an individual may hunt with a bow and arrow or crossbow.
(3) Beginning November 18, 2023, through December 3, 2023, an individual may hunt with a firearm, air gun, or muzzleloading gun.
(4) Beginning December 9, 2023, through December 24, 2023, an individual may hunt with a muzzleloading gun.

(e) An individual who is issued a license to hunt deer under subsection (c)(1)(A), (c)(1)(B), or (c)(1)(D) may take one (1) antlerless deer for each deer license issued under this SECTION.

(f) An individual who hunts antlerless deer under this SECTION may use:
(1) an airgun;
(2) a bow and arrow;
(3) a crossbow;
(4) a muzzleloading gun; or
(5) any other firearm that may be used to take deer under 312 IAC 9-3, IC 14-22-2-8, or IC 14-22-2-9.

(g) The following apply to a license to hunt deer under this SECTION:
(1) 312 IAC 9-3-2(b) through 312 IAC 9-3-2(d); and
(2) 312 IAC 9-3-2(m) through 312 IAC 9-3-2(z).

(h) An individual may not exceed the following county bag limits:
(1) Adams - 1.

(5) Austin Bottoms Conservation Area.
(6) Beaver Dam Wetland Conservation Area.
(7) Big Barbee Wetland Conservation Area.
(8) Bittern Bog Wetland Conservation Area.
(9) Blue Grass Fish and Wildlife Area.
(10) Bob Kern Nature Preserve.

(b) An individual may take not more than:

during the special youth deer season under 312 IAC 9-3-4(b) on a property listed in subsection (a).

(b) An individual may take from a designated property under subsection (a) not more than the following:
(1) Two (2) antlerless deer with a license issued under 312 IAC 9-3-2(f) during the archery season established under 312 IAC 9-3-4(c) with archery equipment authorized by 312 IAC 9-3-3(b).
(2) One (1) antlerless deer with a license issued under 312 IAC 9-3-2(i) during the muzzleloader season established under 312 IAC 9-3-4(f) with a muzzleloading gun as authorized by 312 IAC 9-3-3(e).

(c) Except as provided in subsection (b) and SECTION 2 of this document, an individual may not take an antlerless deer on a designated property under this SECTION beginning September 25, 2023, through January 7, 2024.

SECTION 4. SECTIONS 1 through 3 of this document expire on February 1, 2024.
