TITLE 140 BUREAU OF MOTOR VEHICLES

Governor's Approval
LSA Document #23-519

Under IC 4-22-2-37.2, the Governor gives the Bureau of Motor Vehicles approval to publish an Interim Rule concerning the issuance of a driver's license, permit, or identification card, or registrations of certificates of title, to an individual granted parole to remain in the United States under 8 U.S.C. 1182(d)(5).

Letter of Governor's Approval dated June 15, 2023:

Mr. Joseph B. Hoage
Commissioner
Bureau of Motor Vehicles
100 N. Senate Avenue
Indianapolis, IN 46204

Dear Commissioner Hoage:

Pursuant to the provisions of Indiana Code § 4-22-2-37.2, the Governor has reviewed the proposed interim rule that amends 140 IAC 6-1-2, 140 IAC 7-1.1-1, and 140 IAC 7-1.1-3, which you submitted on June 14, 2023.

The Governor hereby finds, pursuant to Indiana Code § 4-22-2-37.2(b)(1), that the proposed interim rule is necessary to implement a new state law, specifically Indiana Code § 9-14-8-3.5 which went into effect upon the passage of HEA 1050, before a final rule can take effect. The new law took effect upon passage, the existing emergency rule expires on August 3, 2023, and a regular rule is not expected to be completed until on or about October 19, 2023.

The Bureau of Motor Vehicles may proceed with the interim rule proposed in its submission.

Sincerely,
Joseph R. Heerens
General Counsel
