Notice of School-Based Services Updates


In accordance with public notice requirements established at 42 CFR 447.205, the Indiana Family and Social Services Administration (FSSA), Office of Medicaid Policy and Planning (OMPP) publishes this notice of proposed changes to expand the mandated federal and state educational plans that can authorize coverage of medically necessary school-based Medicaid services that are provided under federal or state mandates. The public notice period will run 5/3/2023 through 6/2/2023.

FSSA – OMPP proposes to expand the type of educational programs or plans that may authorize Medicaid eligible services. Currently, Indiana Medicaid only reimburses schools through an approved individualized education program. This amendment will allow Indiana Medicaid to reimburse for mandated school-based services pursuant to a Medicaid enrolled student's educational program or plan as required by the Individuals with Disabilities Education Act (IDEA) or Section 504 of the federal Rehabilitation Act of 1973. 29 U.S.C. 794. These changes will be effective July 1, 2023.

OMPP is making these changes to align with HEA 1192 (2022).This state plan amendment will therefore make conforming changes to the Medicaid state plan to accommodate the required changes. This amendment will ease administrative burden placed on school-based health providers to promote their participation in the Medicaid program and thereby increase access to Medicaid-covered services for Medicaid-enrolled students, while also maintaining fiscal and programmatic integrity of the Medicaid program. This amendment will also clarify that department of education licensed school psychologists are qualified providers to provide psychologist services within their scope of practice and pursuant to a Medicaid enrolled student's educational program or plan as required by the IDEA or Section 504 of the federal Rehabilitation Act of 1973. 29 U.S.C. 794.

A copy of this notice is now on file at the Indiana Government Center South, 402 West Washington Street, Room W451, Indianapolis, Indiana and is open for public inspection. Also, a copy of this notice is now available and may be inspected by contacting the local county Division of Family Resources office, except in Marion County, where public inspection may be made at 402 West Washington Street, Room W374, Indianapolis, Indiana.
