Public Notice Regarding a Proposed Selective Contracting Waiver


In accordance with public notice requirements established at 42 CFR 447.205, The Indiana Family and Social Services Administration (FSSA) Office of Medicaid Policy and Planning (OMPP), and the Division of Mental Health and Addiction (DMHA) intend to submit a proposed 1915(b)(4) selective contracting waiver application to the Centers for Medicare and Medicaid Services for consideration.

The proposed 1915(b)(4) selective contracting waiver will operate concurrently with DMHA's Adult Home- and Community-Based Services programs, Adult Mental Health Habilitation (AMHH), and Behavioral and Primary Healthcare Coordination (BPHC), with an effective date of October 1, 2023.

AMHH and BPHC programs provide Medicaid home- and community-based services to members in a range of community settings as an alternative and prevention to institutional care. The programs serve persons with various behavioral health needs, including serious mental illness and substance use disorders. Recipients of AMHH or BPHC may choose to live in their own home, family home, or community setting appropriate to their needs. The goal of AMHH and BPHC is to provide access to meaningful and necessary home- and community-based services and supports, seek to implement person-centered services and supports in a manner that respects the recipient's personal beliefs and customs, ensure that services are cost-effective, facilitate the recipient's involvement in the community where the recipient lives and works, and facilitate the recipient's independent living.

The 30-day public comment period for the selective contracting waiver application will run from January 25, 2023, through February 24, 2023. Comments can be emailed to spacomment@fssa.in.gov or mailed to:

The 1915(b)(4) waiver application will be available for review and comment on DMHA's Public Comment webpage (https://www.in.gov/fssa/dmha/Public-Comment/) on or before January 25, 2023. Hard copies of the proposed amendments are available upon request at the address contained herein. Additionally, copies of the proposed amendments are available at local Department of Family Resources offices.
