Public Notice Regarding Amendment of the Aged and Disabled Waiver
January 18, 2023


In accordance with public notice requirements established at 42 CFR 447.205, the Indiana Family and Social Service Administration (FSSA) Office of Medicaid Policy and Planning (OMPP) and the Division of Aging (DA) intends to submit a renewal for the Aged and Disabled (A&D) waiver to the Centers for Medicare and Medicaid Services for consideration.

The A&D waiver provides Medicaid home and community-based services (HCBS) to participants in a range of community settings as an alternative to care in a nursing facility for adults and persons of all ages with a disability. The waiver is designed to provide services to supplement informal supports for persons who would require care in a nursing facility if waiver or other supports were not available. Waiver services can be used to help people remain in their own home, as well as assist people living in nursing facilities return to community settings such as their own homes, apartments, assisted living, or adult family care.

The FSSA–OMPP and DA proposes to amend the A&D waiver to make permanent the Expedited Waiver Eligibility (EWE) program currently allowed through the Appendix K authority. This EWE amendment would allow potential, at-risk individuals who are 65 years of age and older to complete a shortened, preliminary eligibility test to receive HCBS quicker in lieu of receiving services through nursing facilities before a more formal eligibility determination is conducted.

Additional budget information can be found in Appendix J of the A&D waiver renewal. The 30 day public comment period for the Traumatic Brain Injury waiver renewal will run from January 18, 2023, through February 17, 2023.

The A&D waiver renewal will be available for review and public comment on the DA Draft Policies for Public Comment webpage (https://www.in.gov/fssa/da/public-comments/). Hard copies of the proposed renewal are available upon request at the address contained herein. Additionally, copies of the proposed renewal are available at local Division of Family Resources offices as well as local Area Agencies on Aging offices.
