TITLE 312 NATURAL RESOURCES COMMISSION

Amends 312 IAC 5-7-1 to identify speed zones with signage at the coordinates, rather than just onsite buoys, and to remove references to navigable waterways. Adds 312 IAC 5-7-16 concerning an idle speed zone on the St. Mary's River. Adds 312 IAC 5-7-17 concerning an idle speed zone on the St. Joseph River. Adds 312 IAC 5-7-18 concerning an idle speed zone on the Maumee River. Effective 30 days after filing with the Publisher.

IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses

SECTION 1. 312 IAC 5-7-1 IS AMENDED TO READ AS FOLLOWS:

Affected: IC 14; IC 32-19-1-1

Sec. 1. (a) This rule establishes boating zones on specified navigable waterways public waters, other than Lake Michigan and its tributaries in Lake, Porter, and LaPorte counties, to govern the operation of boats for any of the following purposes:

(1) Addressing unusual conditions or hazards.

(2) Fish, wildlife, or botanical resource management.

(3) The protection of users.

(b) This rule may modify or supplement 312 IAC 6.

(c) (b) In order to be effective, a zone established under this rule must be identified with signage at the coordinates or onsite by buoys placed under 312 IAC 5-4.

(c) The coordinates used in this rule have the meaning set forth in IC 32-19-1-1, 312 IAC 1-1-27.5, and 312 IAC 1-1-29.3 and referenced as "SPC" and "UTM".

SECTION 2. 312 IAC 5-7-16 IS ADDED TO READ AS FOLLOWS:

Sec. 16. (a) This section establishes a special boating zone on the St. Mary's River.

(b) A person must not operate a boat in excess of idle speed within a zone that lies between the Main Street Bridge to the confluence of the St. Mary's River, St. Joseph River, and Maumee River:

(1) beginning at the Main Street Bridge (16 T 655040 UTM 4549114); and

(2) continuing downstream to the confluence (16 T 656887 UTM 4549687).

SECTION 3. 312 IAC 5-7-17 IS ADDED TO READ AS FOLLOWS:

Sec. 17. A person must not operate a boat in excess of idle speed within a zone that lies between the Tennessee Avenue Bridge to the confluence of the St. Mary's River, St. Joseph River, and Maumee River:

(1) beginning at the Tennessee Avenue Bridge (16 T 657134 UTM 4550355); and

(2) continuing downstream to the confluence (16 T 656887 UTM 4549687).

SECTION 4. 312 IAC 5-7-18 IS ADDED TO READ AS FOLLOWS:

Affected: IC 14

Sec. 18. (a) This section establishes a special boating zone on the Maumee River.

(b) A person must not operate a boat in excess of idle speed within a zone that lies between the Columbia Avenue Bridge to the confluence of the St. Mary's River, St. Joseph River, and Maumee River:

(1) beginning at the Columbia Avenue Bridge (16 T 656902 UTM 45495760); and

(2) continuing upstream to the confluence (16 T 656887 UTM 4549687).
