TITLE 812 INDIANA AUCTIONEER COMMISSION

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Indiana Auctioneer Commission intends to adopt a rule concerning the following:

OVERVIEW: Amends 812 IAC 1-1-19 concerning contracts. Amends 812 IAC 1-1-24 concerning unprofessional conduct. Amends 812 IAC 1-1-31 concerning student auctioneers and supervision. Amends 812 IAC 2-3-3 concerning instructors. Amends 812 IAC 2-4-1 concerning auctioneer courses. Amends 812 IAC 2-4-4 concerning examinations. Amends 812 IAC 2-6-1 concerning auctioneer courses online and in person. Amends 812 IAC 2-7-13 concerning computers designed for auction purposes. Amends 812 IAC 2-7-17 concerning subject matter. Amends 812 IAC 3-1-1 concerning continuing education requirements. Amends 812 IAC 3-1-5 concerning course records. Amends 812 IAC 3-1-6 concerning continuing education sponsors. Amends 812 IAC 3-1-8 concerning instructors. Amends 812 IAC 3-1-10 concerning renewal applications. Amends 812 IAC 3-2-1 to update the definition of "distance learning continuing education". Amends 812 IAC 3-2-6 concerning digital instruction. Amends 812 IAC 3-2-7 concerning online continuing education. Repeals 812 IAC 1-1-13, 812 IAC 1-1-16, 812 IAC 1-1-16.1, 812 IAC 1-1-38, and 812 IAC 3-1-12. Statutory authority: IC 25-6.1-2-5.

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-6, specifically IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
