Notice of Changes to Adult Mental Health and Habilitation Required Attestation


In accordance with public notice requirements established at 42 CFR 447.205, the Indiana Family and Social Services Administration (FSSA), Office of Medicaid Policy and Planning (OMPP) publishes this notice to change the required attestation to qualify for the Adult Mental Health and Habilitation program (AMHH). The public notice period will run 6/1/2022 to 7/1/2022.

FSSA – OMPP proposes to modify the required attestation to qualify for AMHH. The proposal would change the required attestation to qualify for the program from only a health service provider in psychology (HSPP) that can attest for AMHH to allowing a licensed clinical social worker (LCSW), a licensed marriage and family therapist (LMFT), a licensed mental health counselor (LMHC), and a licensed clinical addiction counselor (LCAC) to attest for an individual to qualify for the program. These changes will be effective July 1, 2022.

OMPP is making these changes in order to comply with Senate Enrolled Act 82, signed into law by Governor Holcomb on April 29, 2021. It is estimated that there will be no fiscal impact as a result of these changes.

A copy of this notice is now on file at the Indiana Government Center South, 402 West Washington Street, Room W451, Indianapolis, Indiana and is open for public inspection. Also, a copy of this notice is now available and may be inspected by contacting the local county Division of Family Resources (DFR) office, except in Marion County, where public inspection may be made at 402 West Washington Street, Room W374, Indianapolis, Indiana. Also, the AMHH State Plan Amendment (SPA) is available for review and public comment on the DMHA-A Draft Policies for Public Comment webpage (https://www.in.gov/fssa/dmha/3103.htm).
