Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on May 20, 2022, at 10:00 a.m., at the Indiana Department of Health, 2 North Meridian Street, Indianapolis, Indiana, the Indiana Department of Health will hold a public hearing on proposed rule 410 IAC 1-8 (LSA Doc #22-42) to add provisions governing standards of operation for facilities that are not currently licensed as beauty culture salons where eyelash extensions are applied to members of the public. Additionally, the proposed rule adds criteria eyelash extension certification programs must meet to be considered a recognized program by the Indiana Department of Health. Lastly, the proposed rule adds education and training requirements for individuals who are not currently licensed estheticians or currently licensed cosmetologists but wish to apply eyelash extensions to members of the public.
The Indiana Department of Health has the authority to adopt this rule under IC 16-19-3-4.5.

P.L. 55-2021 requires the Indiana Department of Health to adopt rules setting out training and sanitation requirements for eyelash extension services. Pursuant to IC 4-22-2-24(d)(3), these requirements are necessary to protect Indiana's public from hazards of unsanitary or unskilled eyelash extension services including, but not limited to, trauma to or infection of the eyelid or cornea, an allergic reaction to the glue, and permanent or temporary loss of eyelashes.
Copies of these rules and any documents used to determine justification for the requirements are now on file at the Office of Legal Affairs, Indiana Department of Health, 2 North Meridian Street, Indianapolis, Indiana and are open for public inspection and copying.
