On behalf of the Indiana Department of Health (IDOH), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule, unless a notice is filed with the Publisher stating the reasons for the agency's noncompliance.

The proposed rule is authorized by the new regulation of eyelash extension facilities codified at IC 16-19-3-4.5 that was effective July 1, 2021. As permitted by the statute, an emergency rule was published on January 5, 2022, and anticipated to be extended on April 1, 2022. Due to IDOH devoting time gathering information about eyelash extension services and seeking input from stakeholders, the rulemaking process for a new proposed rule officially began with the Notice of Intent submitted on February 15, 2022, and posted on February 23, 2022 (DIN: 20220223-IR-410220042NIA).
