Notice of Changes in Methods and Standards for Medicaid
Nonemergency Medical Transportation (NEMT)


In accordance with public notice requirements established at 42 CFR 447.205 of the Social Security Act, the Indiana Family and Social Services Administration (FSSA), Office of Medicaid Policy and Planning (OMPP) publishes this notice of proposed changes to ensure state compliance with the statutory minimum requirements for NEMT providers and individual drivers. The public notice period will run 10/27/2021-11/26/2021.

OMPP proposes to make conforming changes to the Medicaid State Plan to add assurances for certain transportation provides are required by the Center for Medicaid and CHIP Services (CMCS). The State Plan will now include language attesting to:
A. Each provider and individual driver is not excluded from participation in any federal health care program (as defined in section 1128B(f) of the Act) and is not listed on the exclusion list of the Inspector General of the Department of Health and Human Services;
B. Each such individual driver has a valid driver's license;
C. Each such provider has in place a process to address any violation of a state drug law; and
D. Each such provider has in place a process to disclose to the state Medicaid program the driving history, including any traffic violations, of each such individual driver employed by such provider, including any traffic violations.
These changes shall be effective 12/27/2021. There will be no fiscal impact as a result of these changes.

A copy of this notice is now on file at the Indiana Government Center South, 402 West Washington Street, Room W451 and is open for public inspection. Also, a copy of this notice is now available and may be inspected by contacting the local county Division of Family Resources office, except in Marion County, where public inspection may be made at 402 W. Washington Street, Room W374, Indianapolis, Indiana.
