Temporarily adds new a new definition for purposes of IC 16-44-2 and clarifies acceptable vapor tests for gasohol. Statutory authority: IC 4-22-2-37.1; IC 16-19-3-5; IC 16-44-2-13. Effective June 11, 2021.


SECTION 1. "Gasohol" has the meaning set forth in IC 16-44-2-8(b)(1)(E). For purposes of IC 16-44-2, this definition includes both E10 and E15 ethanol blends as set forth in 40 CFR 1090.80 as incorporated by reference.

SECTION 2. For purposes of IC 16-44-2-8(b)(1)(E), the acceptable vapor pressure tests for gasohol are Method ASTM D-4953, ASTM D-5191, or any other ASTM method to determine vapor pressure approved by the United States Environmental Protection Agency.

SECTION 3. The vapor pressure limits for gasohol in IC 16-44-2-8(b)(1)(E) apply to both E10 and E15 ethanol blends as set forth in 40 CFR 1090.80.

SECTION 4. (a) When used in this document, references to the following publications shall mean the version of the publication listed in this SECTION. 40 CFR 1090.80 (January 1, 2021) is hereby incorporated by reference.

(b) Federal rules that have been incorporated by reference do not include any later amendments than those specified in the incorporated citation. Sales of the Code of Federal Regulations are handled exclusively by the Superintendent of Documents, Government Printing Office, Washington, D.C. 20402.

SECTION 5. SECTIONS 1 through 4 [sic, of] this document take effect June 11, 2021.
