Notice of Changes to the Long-Term Care Insurance Partnership Program


In accordance with public notice requirements established at 42 CFR 447.205, the Indiana Family and Social Services Administration (FSSA), Office of Medicaid Policy and Planning (OMPP) publishes this notice of proposed changes to the Long-Term Care Insurance Partnership program. The public notice period will run from May 26, 2021, through June 25, 2021.

FSSA – OMPP proposes to change the Long Term Care Insurance Partnership program that would (1) provide for the establishment of the new Long Term Care Insurance Partnership program and the discontinuance of the current Long Term Care Insurance Partnership program; and (2) ensure that an individual who purchased a qualified Long Term Care Insurance Partnership policy under the current program will be eligible for an asset disregard even if the current program is discontinued and even though the policy was issued before the date of the State Plan Amendment, is not tax qualified, and does not meet the standards of Section 6021 the federal Deficit Reduction Act. These changes will be effective July 1, 2021.

OMPP is making these changes in order to comply with House Enrolled Act 1405.This legislation changes the Long-Term Insurance Partnership Program to follow Section 6021 the federal Deficit Reduction Act and will remove the option of total asset protection for newly established Long Term Care Insurance Partnership Program polices. This SPA will therefore make conforming changes to the Medicaid State Plan to reflect state legislation adding language that Long Term Care Insurance Partnership program will follow Section 6021 the federal Deficit Reduction Act, remove the Total Asset Protection option and will grandfather in any current policy holders. There will be no fiscal impact as a result of these changes.

A copy of this notice is now on file at the Indiana Government Center South, 402 West Washington Street, Room W451 and is open for public inspection. Also, a copy of this notice is now available and may be inspected by contacting the local county Division of Family Resources (DFR) office, except in Marion County, where public inspection may be made at 402 W. Washington Street, Room W374, Indianapolis, Indiana.
