On behalf of the Indiana Gaming Commission (IGC), I am submitting this notice to the Publisher of the Indiana Register in compliance with
IC 4-22-2-25, which requires that a notice be sent to the Publisher if a rule will not be approved or deemed approved by the Governor within one year of publication of the Notice of Intent to Adopt a Rule.
The IGC published a Notice of Intent to Adopt a Rule on August 12, 2020 (DIN:
20200812-IR-068200420NIA). This electronic notice is being submitted prior to April 19, 2021, the 250th day following the publication of the Notice of Intent to Adopt a Rule under
IC 4-22-2-23.
The IGC is unable to guarantee the completion of the IGC's sports wagering rule promulgation and approval by the Governor's office by the 1-year timeline described in
IC 4-22-2-25. Contributing to this delay were the need to alter the Commission meeting schedule to accommodate other business needs, as well as various steps in the promulgation process that required more time than anticipated. For this reason, the IGC is hereby notifying the Publisher of the Indiana Register. The IGC anticipates that the final rule will be approved by the IGC by the end of May 2021, with approval from the Governor's office obtained by August 23, 2021.
