Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on February 24, 2021, at 9:00 a.m., Indianapolis (Eastern) time, via video conference accessible online or via telephone, the Fire Prevention and Building Safety Commission (Commission) will hold a public hearing on a proposed rule to modify
675 IAC 12-3-4 and
675 IAC 12-5 (the rules establishing administrative procedures, the application fees, and general provisions for the exercise of the authority to grant variances to the rules adopted by the Commission) for purposes of implementing statutory changes made to
IC 22-13-2-11 (the statute governing variances to rules of the Commission) by Public Law 249-2019 SECTION 24. In general, the proposed rule carries forward a slightly modified version of the current emergency rule which has been in place since July 2, 2019. See LSA Document #19-333(E).

This rulemaking is necessary to: (1) implement statutory changes made to
IC 22-13-2-11 by Public Law 249-2019 SECTION 24; and (2) ensure the current regulatory framework for the variance program, which is put into effect by an emergency rule set to expire on July 1, 2021, will continue.
