TITLE 905 ALCOHOL AND TOBACCO COMMISSION

Notice of Intent to Readopt
LSA Document #20-447

Readopts rules in anticipation of IC 4-22-2.5-2, providing that an administrative rule adopted under IC 4-22-2 expires January 1 of the seventh year after the year in which the rule takes effect unless the rule contains an earlier expiration date. NOTE: IC 4-22-2.5-5 authorizes the Governor to postpone, by executive order, the expiration of rules for one year. Executive Order #19-03, issued December 23, 2019, and posted at 20200101-IR-GOV190689EOA, postpones the expiration of 905 IAC 1-15.3-1 and 905 IAC 1-33.1-1 in this document until January 1, 2021. Effective 30 days after filing with the Publisher.

OVERVIEW: Rules to be readopted without changes are as follows:
  905 IAC 1-8  Salesman's Permits 
  905 IAC 1-15.3-1  Employees between eighteen (18) and twenty-one (21) years of age 
  905 IAC 1-23-1  Registration of brands, labels, and trademarks 
  905 IAC 1-29  Selling of Package Alcoholic Beverages by Retail Permittee 
  905 IAC 1-33.1-1  Permit auction 
  905 IAC 1-52  Posting Signs Authorized by IC 7.1-3-1-28

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-6, specifically IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
