Notice of Public Hearing
Under
IC 4-22-2-24, notice is hereby given that on September 9, 2020, at 2:00 p.m. ET, at the Simonton Lake Sportsman Club, 51036 County Road 11, Elkhart, Indiana 46514, the Natural Resources Commission will hold a public hearing on proposed amendments to
312 IAC 5-6-11 to remove the expiration of the special boating zone on Simonton Lake in Elkhart County.
IC 4-22-2-24(d)(3) Justification Statement: The Simonton Lake Homeowners Association will be impacted by this rule because it will be their responsibility to install the buoys marking the boundaries of the restricted zone in the spring and removing them in the fall at the end of the boating season. They have performed this function since 2015 when the rule establishing the Simonton Lake Ecozone was adopted. The cost for hiring this task done would be minimal (less than $500 per year) although the Association would certainly be capable of doing this simple task on their own using volunteers. Boaters on 301 acre Simonton Lake will be impacted because a 10 acre area will continue to be restricted from high speed boating. The restricted area in this rule is a shallow portion of the lake that is a safety hazard for high speed boating. The exclusion of high speed boats within this area will protect against nutrient and sediment suspension resulting in better water quality. Submersed and emergent vegetation will likely improve naturally in this area providing further water quality benefits.
All requirements or costs by the rule amendments on regulated entities under
IC 4-22-2-24(d)(3) are reasonably necessary for the implementation of
IC 14-15-7-3.
