675 IAC 13-2.6 2014 Indiana Building Code, Section 414.1.3 Information Required. A report shall be submitted to the code official identifying the maximum expected quantities of hazardous materials to be stored, used in a closed system, and used in an open system representing hazards that are classified in group H, and subdivided to separately address hazardous material classification categories based on Tables 307.1(1) and 307.1(2). The methods of projection from such hazards, including but not limited to control areas, and fire protection systems, shall be indicated in the report and on the construction documents.
Whether the requirement of Section 414.1.3 applies to retailers of consumer fireworks (1.4G).
Interpretation of the State Building Commissioner
If a retail consumer fireworks facility includes an H occupancy component, the owner of said facility must comply with the requirements of Section 414.1.3 of the 2014 Indiana Building Code. If it does not include an H occupancy component, the requirements of this section do not apply.
Section 414.1.3 expressly applies to buildings or structures containing materials representing hazards that are classified as H occupancies by the code. If a building or structure contains consumer grade fireworks (1.4G) in quantities exceeding the maximum allowable per control area, such building or structure is considered an H-3 occupancy by IBC Section 307.5, and is therefore subject to the reporting requirements of Section 414.1.3. If the material is present in quantities less than the maximum allowable, it is not considered an H occupancy, and is exempt from the reporting requirements of Section 414.1.3.
