Regulatory Flexibility Analysis of Alternative Methods:
The Department of Natural Resources (DNR) has the statutory requirement to provide for the protection, reproduction, care, management, survival, and regulation of wild animal populations in IC 14-22-2-3. Furthermore, the DNR has the statutory authority to allow the taking, possession, and sale of wild animals and to establish the methods, locations, and means of taking wild animals, including fish, in IC 14-22-2-6. The Natural Resources Commission has the statutory authority to adopt rules pursuant to IC 14-10-2-4. The definition of wild animal in IC 14-8-2-318 includes fish. The sale of fish taken from public waters is not allowed under IC 14-22-9-7 with the exception of fish taken by a commercial fishing license or roe harvesters license issued under IC 14-22-13. These proposed rule amendments do not affect licensed commercial fishers, roe harvesters, or other businesses. There are no new reporting, record keeping, or other administrative costs for small businesses as the result of these proposed rule amendments.
There are no market-oriented approaches needed or available since there are no requirements for small businesses.
