IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Estimated Number of Small Businesses Subject to This Rule:
• Approximately ten (10) turtle possession permit holders would be affected by the changes to 312 IAC 9-5-11.
• Approximately forty (40) special purpose educational permit holders would be affected by the changes to 312 IAC 9-10-9.5.
• Approximately twenty (20) nuisance wild animal control permit holders would be affected by the changes to 312 IAC 9-10-11.
• Approximately thirty (30) migratory bird depredation permit holders would be affected by the changes to 312 IAC 9-10-23.

Estimated Average Annual Reporting, Record Keeping, and Other Administrative Costs Small Businesses Will Incur For Compliance:
None.

Estimated Total Annual Economic Impact on Small Businesses To Comply:
There will be a cost savings for these businesses. Turtle possession permit holders that use the turtles for educational programs will save time by not having to get the special purpose educational permit. Special purpose educational permit holders will be able to use wild animals for educational programs at commercial ventures, providing increased opportunities for programs. Nuisance wild animal control businesses that meet the new exemption will save time and travel/registration expenses by not having to retake the test or take classes to meet the continuing education requirement. Businesses that have damage or a health or safety threat due to a bird listed in this rule will save time by not having to complete and submit the paperwork for a migratory bird depredation permit.

Justification Statement of Requirement or Cost:
N/A. There are no new costs or requirements.

Regulatory Flexibility Analysis of Alternative Methods:
The Department of Natural Resources (DNR) has the statutory requirement to provide for the protection, reproduction, care, management, survival, and regulation of wild animal populations in IC 14-22-2-3. Furthermore, the DNR has the statutory authority to allow the taking, possession, and sale of wild animals and to establish the methods, locations, and means of taking wild animals, including fish, in IC 14-22-2-6. The Natural Resources Commission has the statutory authority to adopt rules pursuant to IC 14-10-2-4. The DNR has the statutory authority to issue permits under IC 14-22-2-4 and IC 14-22-6-2, as well as nuisance wild animal control permits under IC 14-22-28.
There are no market-oriented approaches needed or available since there are no requirements for small businesses.
