Notice of Changes in Methods and Standards for Administrative Law Proceedings


In accordance with public notice requirements established at 42 CFR 447.205, the Indiana Family and Social Services Administration (FSSA), Office of Medicaid Policy and Planning (OMPP) publishes this notice of proposed changes to methods and standards governing administrative law proceedings. The public notice period will run April 8, 2020, to May 8, 2020.

OMPP proposes to delegate the administrative law proceedings authority to the Indiana Office of Administrative Law Proceedings (OALP). The OALP was formed in 2019 by H.E.A. 1223, to provide Indiana with a central and independent hearing process for many types of disputes involving Indiana's state agencies, including the Family and Social Services Administration (FSSA) Office of Medicaid Policy and Planning (OMPP). This change will be effective July 1, 2020.

The OALP will employ administrative law judges who will provide the parties to the dispute with all process due under the applicable federal and state laws and constitutions. However, the OALP is not the ultimate authority in any administrative proceeding and OALP's decisions are not final agency actions. There will be no fiscal impact as a result of this change.

A copy of this notice is now on file at the Indiana Government Center South, 402 West Washington Street, Room W451 and is open for public inspection. Also, a copy of this notice is now available and may be inspected by contacting the local county Division of Family Resources office, except in Marion County, where public inspection may be made at 402 West Washington Street, Room W374, Indianapolis, Indiana.
