TITLE 410 INDIANA STATE DEPARTMENT OF HEALTH

DIGEST

Amends 410 IAC 15-4-2 and 410 IAC 15-4-7 to update definitions and to update reporting requirements for healthcare associated infections. Adds 410 IAC 15-4-2.5 and 410 IAC 15-4-3.5 to add definitions. Repeals 410 IAC 15-4-5 and 410 IAC 15-4-6. Effective 30 days after filing with the Publisher.




SECTION 1. 410 IAC 15-4-2 IS AMENDED TO READ AS FOLLOWS:

410 IAC 15-4-2 "CDC" defined

Sec. 2. "Centers for Disease Control and Prevention" or "CDC" means the federal agency established under the United States Department of Health and Human Services. Centers for Disease Control and Prevention.

SECTION 2. 410 IAC 15-4-2.5 IS ADDED TO READ AS FOLLOWS:

410 IAC 15-4-2.5 "CMS" defined

Sec. 2.5. "CMS" means the United States Centers for Medicare and Medicaid Services.

SECTION 3. 410 IAC 15-4-3.5 IS ADDED TO READ AS FOLLOWS:

410 IAC 15-4-3.5 "Health care facility" defined

Authority: IC 16-21-1-7; IC 16-41-2-1

Sec. 3.5. "Health care facility" includes the following:
(1) Hospitals licensed under IC 16-21-2.
(2) Private mental health institutions licensed under IC 12-25.
(3) Health facilities licensed under IC 16-28.
(4) Rehabilitation facilities.
(5) End stage renal/dialysis centers.
(6) Any institution, building, or agency or portion thereof, whether public or private where:
(A) nursing, rehabilitative, or preventive care;
(B) treatment;
(C) service; or
(D) procedure;
to maintain, diagnose, or treat an individual's physical or mental condition is provided.

SECTION 4. 410 IAC 15-4-7 IS AMENDED TO READ AS FOLLOWS:

410 IAC 15-4-7 Reportable healthcare associated infections

Sec. 7. Hospitals shall submit all NHSN-required data to the NHSN on the following healthcare associated infections effective January 1, 2012:
(1) Central line associated bloodstream infections in all intensive care units.
(2) Surgical site infections for abdominal hysterectomies and colorectal surgeries.
(3) Catheter associated urinary tract infections in adult and pediatric intensive care units.
(a) A health care facility that participates in a CMS program of any type shall confer to the state department of health the NHSN access rights to its facility specific data contained in the NHSN for all CMS required data reported to NHSN.

(b) Health care facilities who are expelled from the NHSN shall submit the same information through electronic means to the department at the sole cost of the health care facility, if necessary.

SECTION 5. THE FOLLOWING ARE REPEALED: 410 IAC 15-4-5; 410 IAC 15-4-6.
