RE: LSA Document #19-77 - Amends 355 IAC 9 to include violations of 355 IAC 3, Agricultural Ammonia, as well as minor changes to the existing schedule.

On behalf of the Office of Indiana State Chemist, I am submitting this notice to the Publisher of the Indiana Register and Indiana Administrative Code in compliance with IC 4-22-2-25, which requires that a notice be sent to the Publisher if a rule will not be approved or deemed approved by the Governor within one year of publication of the Notice of Intent to Adopt a Rule. This notice is submitted to the Publisher before the two hundred fiftieth day following the publication of the Notice of Intent to Adopt a Rule.

The Notice of Intent to Adopt a Rule was published in the Indiana Register on February 6, 2019 (DIN: 20190206-IR-355190077NIA).

This office is currently waiting on the completion of LSA Document #19-78 to be finalized as changes made in LSA Document #19-78 are reflected in the Civil Penalty revision of LSA Document #19-77. We request that the approval date be extended to allow for proper submission and review by the Attorney General and the Governor's office. This office hopes to have a final rule adopted March 6, 2021. Approval or deemed approval by the Governor is expected not later than May 6, 2021.

This notice is being submitted in a timely manner. October 2, 2019, is the two hundred thirty-eighth day after publication of the Notice of Intent to Adopt a Rule.
