TITLE 312 NATURAL RESOURCES COMMISSION

Emergency Rule

DIGEST

Temporarily amends 312 IAC 1-1-26 by removing subdivision (2), which sets the shore of Lake Michigan at five hundred eighty-one and five-tenths (581.5) feet I.G.L.D. 1985, from the definition of "ordinary high watermark". Effective September 16, 2019.


SECTION 1. (a) This SECTION supersedes 312 IAC 1-1-26.

(b) "Ordinary high watermark" means the following:
(1) The line on the shore of a waterway established by the fluctuations of water and indicated by physical characteristics. Examples of these physical characteristics include the following:
(A) A clear and natural line impressed on the bank.
(B) Shelving.
(C) Changes in character of the soil.
(D) The destruction of terrestrial vegetation.
(E) The presence of litter or debris.

SECTION 2. This document takes effect on September 16, 2019.

SECTION 3. This document expires on September 14, 2020.
