TITLE 675 FIRE PREVENTION AND BUILDING SAFETY COMMISSION
Emergency Rule

Temporarily amends 675 IAC 30-1-1 to adopt by reference updated editions of certain boiler and pressure vessel standards adopted by the Fire Prevention and Building Safety Commission. Statutory authority: IC 22-13-2-8. Effective September 1, 2019.
(b) Those certain four (4) documents, being titled:
(1) the American Society of Mechanical Engineers Boiler and Pressure Vessel Code, 2019 Edition, published by the American Society of Mechanical Engineers, Three Park Avenue, New York, New York 10016-5990;
(2) the American Petroleum Institute - American Society of Mechanical Engineers Code for Unfired Pressure Vessels, 1951 Edition, published by the American Society of Mechanical Engineers and the American Petroleum Institute, 345 East 47th Street, New York, New York 10017-2392;
(3) the National Board of Boiler and Pressure Vessel Inspectors Inspection Code (NBIC), 2019 Edition, published by the National Board of Boiler and Pressure Vessel Inspectors, 1055 Crupper Avenue, Columbus, Ohio 43229; and
(4) the American Petroleum Institute 510 Pressure Vessel Inspection Code, Tenth Edition, May 1, 2014 (includes Addendum 1, May 1, 2017, and Addendum 2, March 1, 2018), published by the American Petroleum Institute, 1220 L Street, NW, Washington, D.C. 20005;
are hereby adopted by reference, as provided for in 675 IAC 30, and as specifically set forth in subsection (c).
(c) As incorporated by reference in subsection (b)(1), the adoption of the American Society of Mechanical Engineers Code shall be limited to the following sections:
(1) Section I Rules for Construction of Power Boilers.
(2) Section II Materials.
(3) Section III Rules for Construction of Nuclear Facility Components.
(4) Section IV Rules for Construction of Heating Boilers.
(5) Section V Nondestructive Examination.
(6) Section VIII Rules for Construction of Pressure Vessels.
(7) Section IX Welding, Brazing, and Fusing Qualifications.
(8) Section X Fiber-Reinforced Plastic Pressure Vessels.
(9) Section XI Rules for Inservice Inspection of Nuclear Power Plant Components.
(d) No revision, amendment, or interpretation of any of the codes adopted by the fire prevention and building safety commission shall apply in any way to regulated boilers or unfired pressure vessels unless and until it shall have been approved and adopted by the fire prevention and building safety commission under IC 22-13-2-8.
(e) The adoption of documents by reference in subsection (b) shall not allow a delegation of authority in conflict with that for the fire prevention and building safety commission as set forth at IC 22-12-7, IC 22-13-2, and IC 22-15-6 nor for the division of fire and building safety as set forth at IC 22-12-7, IC 22-15-2, IC 22-15-5, and IC 22-15-6.
SECTION 2. This document takes effect September 1, 2019.
SECTION 3. This document expires on the earlier of the following dates:
(1) August 31, 2021.
(2) The date a permanent rule is adopted under IC 4-22-2.
