TITLE 860 INDIANA PLUMBING COMMISSION

Emergency Rule

Temporarily amends 860 IAC 2-1-4. Statutory authority: IC 25-28.5-1-8; IC 25-28.5-1-38; P.L.127-2019, SECTION 2. Effective August 26, 2019.


SECTION 1. (a) This SECTION supersedes 860 IAC 2-1-4.

(b) An applicant who is accepted into an apprenticeship program must supply, along with the application for registration as an apprentice plumber, a copy of a written agreement wherein the applicant is bound jointly with the accepted apprenticeship program in such a way as to obligate the apprenticeship program to timely inform the commission of the applicant's termination from learning the plumbing trade under the auspices of said apprenticeship program.

(c) As an alternative to the requirement in subsection (b), an application may be signed by a representative of an apprenticeship program that meets the requirements of 860 IAC 2-1-1, representing that the applicant is enrolled in the apprenticeship program and that the apprenticeship program will timely inform the commission of the applicant's termination from learning the plumbing trade under the auspices of said school.

(d) Notwithstanding subsections (b) and (c), an applicant who has applied, but has yet to be accepted, into an apprenticeship program may apply for registration as an apprentice plumber, so long as the applicant supplies to the commission:
(1) proof that the applicant has applied for acceptance in a commission approved apprenticeship program;
(2) a statement signed by a licensed plumbing contractor or journeyman plumber who is the employer of the applicant that the prospective apprentice plumber is the employer's employee and will work under the direct and immediate personal supervision of a licensed plumber contractor or journeyman plumber until the occurrence of an event described under IC 25-28.5-1-18.1(d) at which point the registered apprentice plumber shall discontinue working and the licensed plumbing contractor or journeyman plumber charged with supervising the registered apprentice plumber must notify the commission in accordance with IC 25-28.5-1-18.1(e); and
(3) a statement signed by the applicant that the applicant, unless required to discontinue working sooner by the occurrence of an event described under IC 25-28.5-1-18.1(d), will discontinue working as a registered apprentice plumber after the lapse of one (1) year from the date the applicant's application for registration as an apprentice plumber is approved.

(e) An applicant who is registered under subsection (d) and subsequently accepted into an approved apprentice program may continue working under the direct and immediate personal supervision of a licensed plumber contractor or journeyman plumber, so long as the applicant provides to the commission a copy of a written agreement as described in subsection (b).

SECTION 2. This document expires July 1, 2022.
