Notice of Public Hearing

Under IC 4-22-2-24, notice is hereby given that on June 13, 2019, at 11:00 a.m., at the Indiana Department of Transportation, Greenfield District Office, 32 South Broadway Street, Greenfield, Indiana, the Indiana Department of Transportation (INDOT) will hold a public hearing on a proposed rule amending 105 IAC 7-1 and 105 IAC 7-2, repealing 105 IAC 7-3, and adding 105 IAC 7-4 to comply with federal laws, rules, and regulations, to reduce uncertainty in the current statutory language by providing standards and guidelines to the Indiana Department of Transportation and the outdoor advertising industry, and to minimize noncompliance by the outdoor advertising industry with federal and state law.
Pursuant to IC 4-22-2-24(d)(3), INDOT has determined the changes in the rule are necessary to bring the administrative rules into conformity with state and federal law, rules, and regulations. It is meant to eliminate confusion and clarify regulatory requirements. The rule will impose de minimis additional requirements or costs to small businesses in complying with this rule. It will allow INDOT to have more effective control over the outdoor advertising and fulfill its requirements under federal law.
The purpose of this hearing is to receive comments from the public prior to consideration of preliminary adoption of these rules. All interested persons are invited to attend the public hearing and to offer public comments. In lieu of attendance at the public hearing, written comments may be sent to INDOT, Attention: Kiara Patton, 100 North Senate Avenue, IGCN 730, Indianapolis, IN 46204. Correspondence should be identified in the following manner: "COMMENT RE: LSA Document #17-337, Permits, Outdoor Advertising and Scenic By-Ways Rule". Comments may also be submitted at https://www.in.gov/indot/3772.htm or at rulemakingcomments@ indot.in.gov.

Copies of the proposed rule and any data, studies, or analyses referenced in the justification of requirement or costs on regulated entities are available to be inspected and copied at the office of the Indiana Department of Transportation, Office of Permits, Indiana Government Center North, 100 North Senate Avenue, Room N730, Indianapolis, Indiana and are open for public inspection and copying.
