TITLE 326 AIR POLLUTION CONTROL DIVISION

DIGEST

Temporarily amends 326 IAC 1-4 to designate Clark and Floyd counties to nonattainment for the 2015 ozone standard. Statutory authority: IC 13-14-8-1. NOTE: The first extension of this emergency document, LSA Document #18-511(E), posted at 20181121-IR-326180511ERA, effective November 15, 2018, expired February 13, 2019. Effective February 14, 2019.


SECTION 1. (a) This SECTION supersedes 326 IAC 1-4-11.

(b) The following attainment status designations are applicable to Clark County:
Pollutant  Designation 
SO2  Better than national standards. 
CO  Unclassifiable or attainment effective November 15, 1990. 
O3  Nonattainment effective August 3, 2018, for the 2015 8-hour ozone standard.1 
PM2.5  Unclassifiable effective April 15, 2015, for the 2012 annual PM2.5 standard. 
PM2.5  Unclassifiable or attainment effective December 13, 2009, for the 2006 24-hour PM2.5 standard. 
PM10  Unclassifiable effective November 15, 1990. 
NO2  Unclassifiable or attainment effective January 29, 2012, for the 2010 NO2 standard. 
Pb  Unclassifiable or attainment effective December 31, 2011, for the 2008 lead standard. 
1Attainment effective October 23, 2001, for the 1-hour ozone standard for the Louisville area, including Clark County, and is a maintenance area for the 1-hour ozone National Ambient Air Quality Standard (NAAQS) for purposes of 40 CFR Part 51, Subpart X*. The 1-hour standard was revoked effective June 15, 2005.

PM2.5  Unclassifiable effective April 15, 2015, for the 2012 annual PM2.5 standard. 
PM2.5  Unclassifiable or attainment effective December 13, 2009, for the 2006 24-hour PM2.5 standard. 
PM10  Unclassifiable effective November 15, 1990. 
NO2  Unclassifiable or attainment effective January 29, 2012, for the 2010 NO2 standard.

SECTION 3. A variance request from the requirements of this document shall be made in accordance with IC 13-14-8-8.
