Under IC 4-22-2-24, notice is hereby given that on February 19, 2019, at 10:00 a.m., at the Indiana State Department of Health, 2 North Meridian Street, Indianapolis, Indiana, the Indiana State Department of Health (ISDH) will hold a public hearing on a proposed rule to establish a program for the certification of perinatal hospital and birth center levels of care for birth centers, obstetric units, neonatal units, and perinatal centers, including transport rules.

ISDH has the authority to adopt this rule under IC 16-21-13-5. Pursuant to IC 4-22-2-24(d)(3), ISDH has determined this rule will not impose any additional cost or requirement on the regulated entities. ISDH is required to establish a program to certify perinatal levels of care for every hospital and birth center that provides birthing services. ISDH has based its standards on standards of the American Academy of Pediatrics and the American College of Obstetricians and Gynecologists. ISDH performed a gap analysis on this subject and has determined that hospitals and birth centers meet the minimum standards for certification under the current draft of the rule so the regulated entities will not have any required additional cost to comply with this rule. Regulated entities may choose to incur costs to seek a higher level of certification, which may require some change, but this higher certification is not required.
