Under IC 4-22-2-24, notice is hereby given that on December 7, 2018, at 10:00 a.m., at the Natural Resources Commission, Division of Hearings, Indiana Government Center North, 100 North Senate Avenue, Room N103, Indianapolis, Indiana, the Natural Resources Commission will hold a public hearing on the proposed addition of 312 IAC 3-1-3.5 governing a party's participation and representation in a proceeding controlled by the Administrative Orders and Procedures Act, IC 4-21.5-3.

IC 4-22-2-24(d)(3) Justification Statement: The proposed rule imposes administrative requirements. Under the proposed rule, an attorney representing a party will be obligated to file an appearance in accordance with Indiana Rules of Trial Procedure, Rule 3.1. The proposed rule will also compel a party seeking to be represented by a non-attorney to file a formal designation of representation. These administrative requirements will aid in the efficient conduct of administrative review proceedings and protect the integrity of the Natural Resources Commission's final actions while causing a party to incur only de minimis monetary costs.

All requirements or costs imposed by the added rule section on regulated entities under IC 4-22-2-24(d)(3) are reasonably necessary for the implementation of IC 4-21.5-3.
