Under IC 4-22-2-24, notice is hereby given that on December 10, 2018, at 8:30 a.m. local time, at the Indiana Professional Licensing Agency, Indiana Government Center South, 402 West Washington Street, Room W064, Indianapolis, Indiana, the Indiana Board of Pharmacy will hold a public hearing to add 856 IAC 1-43, concerning ephedrine and pseudoephedrine. These rules will establish requirements concerning the sale of products containing ephedrine or pseudoephedrine by pharmacists. The rule will establish requirements regarding "conversion resistant" and "extraction resistant" products containing ephedrine or pseudoephedrine.

This rule imposes no mandated financial cost. The rule establishes criteria for pharmacists to use when determining, in their professional judgment, whether the sale of ephedrine or pseudoephedrine products is for a legitimate need. The rule also imposes requirements on drug manufacturers who seek a board determination that their ephedrine or pseudoephedrine products are "conversion resistant". These requirements are mandated by IC 25-26-13-4, IC 35-48-4-14.3, and IC 35-48-4-14.7.
