IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Pursuant to IC 4-22-2.1-5, the Indiana Emergency Medical Services Commission has prepared this statement describing the annual impact the proposed amendment to 836 IAC 1-1-5 will have on all small businesses after the rule is fully implemented.

Estimated number of small businesses subject to the proposed rule:
It is estimated that 20 small businesses will be subject to this proposed rule. These businesses are in the emergency medical services industry.

Estimated average annual administrative costs small businesses will incur:
It is estimated that the new requirements of this proposed rule will not result in additional administrative costs to small businesses. The software necessary to gather and report these data elements is provided at no cost to all emergency medical service providers by the Indiana Department of Homeland Security. However, it is estimated that it will take an additional two minutes per run for the collection and reporting of this data. These additional two minutes of collection and reporting time is not expected to result in increased billing, work hours, or the need to hire additional employees, but is expected to merely cut into down time between runs.

Estimated total annual economic impact on small businesses:
It is estimated that the new requirements of this proposed rule will not create an economic impact on any small business. As provided above, the additional two minutes it is expected to take in order to collect and report the additional data elements is not expected to result in increased billing, work hours, or the need to hire additional employees. These additional elements will merely cut into down time between runs. However, if assuming that these additional two minutes were to be compensated, this would cost an additional 47 cents per run (based on a $14 an hour salary).

Justification Statement
The imposition of the requirement to collect and report these additional data elements is justified by the following reasons:
(1) To stay current with the national standard in data collection and reporting for the emergency medical services industry;
(2) To improve patient care by being able to recognize trends based on the data elements collected; and
(3) To foster research and the development of evidence based protocols utilizing easily decipherable real-time data.

Regulatory Flexibility Analysis
A regulatory flexibility analysis was performed on this rule and it was determined that there is no less intrusive or less costly alternative method to achieving the purpose of the proposed rule. This amended rule has taken into account all methods mentioned in IC 4-22-2.1-5(a)(5). The requirements of this proposed rule are justified and necessary to obtain critical data needed to recognize and respond to emergency medical services trends in a timely manner.
