TITLE 210 DEPARTMENT OF CORRECTION

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Department of Correction intends to adopt a rule concerning the following:

OVERVIEW: Adds 210 IAC 2-2 to establish and implement regulations for deprivation of earned good time credit of a person placed in a community corrections program for a violation of one or more rules of the department of correction, the penal facility in which the person is imprisoned, the community transition program, the community corrections program, or the department of correction commitment. Earned good time credit may also be deprived if a court determines that a civil claim brought by the person in a state or an administrative court is frivolous, unreasonable, or groundless, if the person is a sex or violent offender (as defined in IC 11-8-8-5) and refuses to register before being released from the department of correction as required under IC 11-8-8-7, or if the person is a sex offender (as defined in IC 11-8-8-4.5) and refuses to participate in a sex offender treatment program specifically offered to the sex offender by the department of correction while the person is serving a period of incarceration with the department of correction.
