Under IC 4-22-2-24, notice is hereby given that on July 10, 2018, at 9:45 a.m., at the Indiana State Board of Animal Health (BOAH), 1202 East 38th Street, Discovery Hall Suite 100, Indianapolis, Indiana, the BOAH will hold a public hearing on a proposed rule that repeals the BOAH rule governing swine enteric coronavirus diseases (SECD) to conform with the March 6, 2018, notice issued by the United States Department of Agriculture (USDA) stating that, effective immediately, the SECD Federal Order was being rescinded. This effect of this action by the USDA is that producers, veterinarians and laboratories are no longer required to report positive cases to federal animal health officials. To align BOAH rules with this recent federal action, the proposed rule amends 345 IAC 1-6-3 to remove the requirement for a diagnostic laboratory or veterinarian to report a diagnosis of porcine epidemic diarrhea virus (PEDv) or porcine deltacoronavirus (PDCoV) in an animal or article from Indiana or whose owner is from Indiana to the state veterinarian within two business days of the diagnosis. The proposed rule repeals 345 IAC 3-6 requiring a herd owner, veterinarian, caretaker, custodian, or laboratory personnel that receives information of a presumptive positive case, confirmed positive case, or negative case of PEDv, PDCoV, or other emerging swine enteric coronavirus disease, in a herd located in Indiana to report that information to the state veterinarian within two business days of receiving the information.
The proposed rule does not impose costs beyond what is expressly required by state and federal law. Therefore, the proposed rule does not impose costs on a regulated entity that would require a justification statement under IC 4-22-2-24(d)(3).
Copies of these rules are now on file at the Indiana State Board of Animal Health, 1202 East 38th Street, Discovery Hall Suite 100, Indianapolis, Indiana and are open for public inspection and copying.
