Re: LSA Document #17-449 – Amendments and Additions to 370 IAC 1-3-2.

On behalf of the Indiana State Egg Board (Egg Board), I am submitting this notice in compliance with IC 4-22-2-25. Pursuant to IC 14-10-2-4, which requires that a notice be sent to the Publisher if a rule will not be approved or deemed approved by the Governor within one year of the publication of the Notice of Intent to Adopt a Rule. This notice is submitted to the Publisher before the two hundred fiftieth day following publication of the Notice of Intent to Adopt a Rule.

The Notice of Intent was published in the Indiana Register on October 11, 2017 (DIN: 20171011-IR-370170449NIA).

The notice is sought because the Egg Board has determined that promulgation of the rule may not be completed within one year after publication of the Notice of Intent to Adopt a Rule. The Egg Board has determined that additional evaluation of the rule is necessary before final action is taken. Additionally, preliminary review by the Attorney General's office identified deficiencies that must be addressed.

The Egg Board hopes to have a final rule adopted by March 1, 2019. Approval or deemed approval by the Governor is expected not later than April 1, 2019.

The 250th day after publication of the Notice of Intent to Adopt a Rule is June 18, 2018. This notice is submitted in a timely manner.
