IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
Estimated Number of Small Businesses Subject to this Rule:
The proposed rule amendments are primarily a housekeeping measure and would neither increase nor decrease the number of small businesses subject to regulation. The proposed rule provides clarity for parties in determining the date a document is filed with the Commission. In addition, the proposed rule amendment may streamline the administrative review process applicable to businesses in certain circumstances.

Estimated Average Annual Reporting, Record Keeping, and Other Administrative Costs Small Businesses Will Incur For Compliance:
None. There are no reporting requirements associated with this proposed rule.

Estimated Total Annual Economic Impact on Small Businesses To Comply:
None or minimal. A business that would traditionally file a document by facsimile would need to use some other form of filing. Other methods of filing are available at no cost.

Justification Statement of Requirement or Cost:
The proposed amendments do not mandate additional requirements on small businesses. The proposed amendments would require a business to file documents in administrative review by a method other than facsimile. For any business that exclusively relies on facsimile as a method to file documents, the business would need to alter its business to file documents in one of the other available methods. Because facsimile is so rarely used, it is not anticipated that a cost would be associated with this change.

Regulatory Flexibility Analysis of Alternative Methods:
Because no additional requirements or costs are imposed, no flexibility analysis was performed.
