IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
The proposed rule will not impose requirements or costs on small businesses under IC 4-22-2.1-5. The proposed rule deletes a regulation on motorcycle safety programs. The regulation currently prohibits the instructor or owner of a motorcycle school who instructed a student in motorcycle operation from administering the motorcycle skills test to that student. A similar prohibition regarding driver's education instructors was recently deleted from IC 9-24-10-1, and a proposed rule will delete the prohibition from 140 IAC 4-4-9. This proposal will eliminate the need for businesses operating a motorcycle safety program to employ two instructors for every one student customer. There are currently seventeen motorcycle safety programs operating in Indiana and one additional organization offering training but not contracting with the Bureau of Motor Vehicles. There are currently 190 certified motorcycle safety RiderCoaches in Indiana. In addition, there are seven contractors offering motorcycle skills testing at nineteen locations. The proposal may positively impact businesses operating motorcycle safety programs via lower operating expenses, which in turn may translate into lower costs for motorcycle safety courses and shorter wait times for students to take the motorcycle safety skills test.
